By accessing Advertology.com a "web site and service" of Advertology, LLC, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law. Advertology, LLC reserves the right to modify these terms of service, the privacy policy, and notice of BETA at any time without prior notice or concent. Continued use of the Service after any such changes shall constitute your consent to such changes.
All services provided by Advertology.com may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Advertology.com from any claims resulting from the use of service which damages the subscriber or any other party.
If your account is found to contain illegal activity, or links to illegal mp3 files, pirated software, hacker programs, warez programs, or any other illegal files, your account will be terminated immediately, without notice. Additionally, Advertology.com will notify the proper authorities of your actions.
Eligibility
A user must be at least 13 years of age to use Advertology.com.
Computer networks or "Bots" are not allowed to access Advertology.com - humans only.
A user must not have already been banned by Advertology.com for violoating the terms of service, privacy policy or notice of beta.
A user is not eligible to use Advertology.com for the purposes of gaining anti-competitve knowledge, reverse engineering, or data mining.
A user may not block any advertising on advertology.com
Registration but occur by a human and not through an automatic system.
Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.
All sub-networks, distributive hosting sites and dedicated servers of Advertology.com must adhere to the above policies, with the exception of system resources in respect to dedicated servers.
No Resale
Advertology.com does not allow, permit, or contduct resale activities of any Advertology.com content or service. Embeding Advertology.com within AJAX, IFRAMES or other system of external domain viewing is strickly prohibited.
Blocking IP Addresses
Advertology.com reserves the right to block IP addresses for any reason with out prioir notice or consent.
Account Activation
By activating your account with Advertology.com, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.
Disclaimer
The materials on Advertology.com are provided "as is". Advertology.com makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Advertology.com does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
Advertology.com cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Advertology.com holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as Advertology.com sees fit.
Limitation of Liability
Advertology.com shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Advertology.com's servers going off-line or being unavailable for any reason whatsoever. Furthermore, Advertology.com shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Advertology.com's servers. All damages shall be limited to the immediate termination of service.
In no event shall Advertology.com or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Advertology.com, even if Advertology.com or a Advertology.com authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Acceptable Use
Because Advertology.com cannot monitor or censor the Internet, and will not attempt to do so, Advertology.com cannot accept any responsibility for injury to its subscribers resulting from inaccurate, unsuitable, offensive or illegal Internet communications.
Spamming
Sending unsolicited bulk and/or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward Advertology.com, but also because it can overload Advertology.com's network and disrupt service to Advertology.com's subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, Advertology.com will investigate and shutdownthe account that is SPAMing. Furthermore Advertology.com reserves the right to prosecute for this violation.Adult-Oriented Content
Advertology.com does not allow adult content and will suspend/terminate any offending account.Obscene Speech or Materials
Using Advertology.com's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. Advertology.com is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.Defamatory or Abusive Language
Using Advertology.com's network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language.Forging of Headers
Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.Illegal or Unauthorized Access to Other Computers or Networks
Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity).Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities
Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.Facilitation a Violation
Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate these terms of service, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks and piracy of software.Other Illegal Activities
Engaging in activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.

Advertology® is a registered trademark with the United States Trademark and Patent Office. Unauthorized use the name Advertology, Advertology.com, or Advertology LLC is not permitted.
All material uploaded or entered into Advertology.com by the user does not fall under Advertology.com's copyright claim. Advertology.com does reserve copyright on all html/css code as well as the look and feel of the site design. Duplication or of use is not permitted unless written concent is obtained.
All systems unless otherwise specified are proprietary systems of Advertology.com and Advertology, LLC.
Violations
Violations of these Acceptable Use Policies should be submitted to Advertology.com's contact page. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.
